By using the website, platform or services of Homadu, the user accepts this disclaimer.

General information
Homadu provides software that allows owners, managers and landlords of accommodations, such as holiday homes, B&Bs, apartments and other stays, to create and manage their own rental website.

Through Homadu, users can, among other things, manage accommodations, show availability, receive direct bookings, connect calendars with external platforms and set up automatic guest communication.

The information on the website and within the Homadu platform is intended as general information about the software and services offered. Although Homadu compiles this information with care, it cannot be guaranteed that all information is always complete, correct, up to date or error-free.

No guarantee of bookings or income
Homadu provides users with tools to present their accommodation professionally online and to enable direct bookings.

However, Homadu does not guarantee the number of visitors, enquiries, reservations, bookings, income, occupancy rate or commercial results achieved through the use of the software.

The success of a rental website depends, among other things, on factors such as location, pricing, availability, quality of the accommodation, photos, texts, marketing, competition, reviews, seasonal influences and the user’s own management.

The user remains personally responsible for the commercial operation of his or her accommodation.

User’s own responsibility
The user is responsible for all information, settings, prices, availability, accommodation details, images, texts, terms and other content entered, published or used through Homadu.

This includes, among other things:

  • the accuracy of accommodation details;
  • prices and surcharges;
  • availability and calendar settings;
  • cancellation terms;
  • house rules;
  • payment settings;
  • contact details;
  • legal information that must be stated on the user’s own rental website;
  • communication with guests;
  • follow-up of bookings and enquiries.

Homadu does not routinely review the content of information posted or entered by users and is not liable for errors, omissions or their consequences.

Responsibility for laws and regulations

Users are responsible for complying with all applicable laws and regulations that apply to their accommodation, rental activities and communication with guests.

This may include, among other things:

  • local rules for holiday rentals;
  • permits or notification obligations;
  • tourist tax;
  • VAT and tax obligations;
  • consumer law;
  • privacy legislation;
  • rules regarding cookies and tracking;
  • fire safety and other safety regulations;
  • information obligations towards guests.

Homadu provides software and technical support, but does not provide legal, tax, financial or administrative advice. Information from Homadu should therefore not be regarded as professional advice.

In case of doubt, the user should seek advice from a legal, tax or other qualified adviser.

Availability of the website and software
Homadu aims to provide stable and reliable operation of the website, software and connected services. Nevertheless, Homadu cannot guarantee that the website or software will always be available without interruptions, delays, disruptions or errors.

Availability may be affected by, among other things:

  • maintenance work;
  • technical failures;
  • server problems;
  • internet outages;
  • updates;
  • security measures;
  • errors in external connections;
  • force majeure situations.

Homadu is not liable for damage, loss of income, missed bookings or other consequences arising from temporary unavailability, disruptions or errors in the software, unless there is intent or deliberate recklessness on the part of Homadu.

External connections and platforms
Homadu may offer connections or integrations with external services, such as payment providers, calendar connections, channel managers, booking platforms, analytics services or other external systems.

Examples may include connections with platforms such as Airbnb, Booking.com, VRBO, Expedia or similar services, depending on the available functionalities and settings.

Homadu is not responsible for the operation, availability, terms, changes, errors, disruptions or decisions of external parties. The use of external services also depends on the terms and technical availability of those parties.

If an external connection temporarily or permanently does not function properly, this may affect availability, synchronisation, bookings, payments or communication. Homadu will try to handle such situations carefully where possible, but cannot guarantee the functioning of external parties.

Calendar connections and availability
Homadu may offer functionalities for connecting or synchronising calendars and availability with external platforms.

Although Homadu handles calendar information carefully, it cannot be fully guaranteed that synchronisations will always take place immediately, without errors or completely. Delays, double bookings, incorrect availability or missed synchronisations may occur due to user settings, external platforms, technical limitations or delays in external systems.

The user remains responsible for checking availability, reservations and calendar data, especially when multiple platforms or systems are used at the same time.

Payments via Stripe
Payments for Homadu are processed via Stripe. Depending on the selected subscription and the available payment methods, payment may be made via iDEAL, credit card or SEPA direct debit, among other methods.

For monthly subscriptions, an automatic monthly direct debit or recurring payment may start after the first payment. For annual subscriptions, payment generally takes place annually.

Homadu processes payments via Stripe, but is not responsible for outages, delays, refusals, payment problems, banking issues or technical errors within Stripe or at the banks and payment institutions involved.

Stripe’s terms and privacy statement may also apply to payments.

Trial period and taking websites offline
Homadu may offer users a free trial period. During this trial period, the user can try out the system and the available functionalities.

After the trial period ends, the website may automatically be taken offline if no active subscription has been taken out. Logging in and further exploring the system may remain possible, depending on the settings, but the public live availability of the website may be disabled.

Homadu is not liable for missed bookings, loss of visibility or other consequences if a website is taken offline after the trial period because no paid subscription has been activated.

Content of users’ websites
Users can create and manage their own website with Homadu. The content of these websites is generally provided, configured or published by the user.

Homadu is not responsible for the content of users’ websites, including texts, images, prices, terms, claims, offers, reviews, availability or other information.

The user indemnifies Homadu against claims from third parties arising from content posted or provided by the user, incorrect information, infringement of third-party rights or violation of laws and regulations.

Images, texts and third-party rights
The user is responsible for the use of images, logos, texts, videos, trademarks, trade names and other materials uploaded or published through Homadu.

The user must ensure that he or she has the correct rights, permissions or licences to use these materials.

Homadu is not liable for infringement of copyrights, trademark rights, portrait rights or other third-party rights caused by material provided or posted by the user.

Security and data
Homadu takes appropriate technical and organisational measures to secure the software and data as well as possible. However, no system can guarantee complete security.

The user is responsible for careful use of the account, including securely storing login details, choosing strong passwords and limiting access to authorised persons.

Homadu is not liable for damage resulting from unauthorised access caused by careless use by the user, shared passwords, infected devices, phishing or other circumstances outside Homadu’s control.

Privacy and personal data
Homadu processes personal data in accordance with Homadu’s Privacy Statement.

Users who collect or process guests’ personal data through Homadu are responsible for the lawful processing of that data within their own rental activities. This may include booking details, contact details, payment details, guest communication and any statutory retention obligations.

Homadu provides technical support for this through the platform, but the user remains responsible for providing guests with correct information and complying with applicable privacy rules.

Cookies and tracking
Homadu may offer functionalities for cookies, tracking, statistics or external services such as Google Analytics, if these are enabled.

The user remains responsible for correctly informing visitors to their own website about cookies, tracking and data processing, and for obtaining consent where legally required.

Homadu may provide tools, such as a cookie banner or settings, but does not guarantee that every configuration automatically fully complies with all applicable legislation in every country where the user is active.

Translations and international availability
Homadu may be available in multiple languages and may be used internationally. Translations of texts, terms or parts of the software are prepared with care, but may contain differences in interpretation.

To the extent that there is a difference between the Dutch version and a translation of legal documents or terms, the Dutch version shall prevail, unless expressly agreed otherwise in writing.

The user remains responsible for complying with local rules in the country or area where the accommodation is offered or rented out.

Changes to software, services and information
Homadu may change the website, software, functionalities, prices, texts, documentation and this disclaimer whenever this is necessary or desirable.

Homadu aims to communicate important changes carefully, but is not obliged to personally notify users in advance of every change, unless legally required or expressly agreed otherwise.

The most current version of this disclaimer is the version published on the Homadu website.

Links to external websites
The Homadu website or software may contain links to external websites or third-party services.

Homadu has no control over the content, operation, security or availability of these external websites and is not responsible for them. Visiting or using external websites is at the user’s own risk.

Limitation of liability
Homadu is not liable for direct or indirect damage arising from the use of Homadu’s website, software, services or information, unless there is intent or deliberate recklessness on the part of Homadu.

Damage includes, among other things:

  • loss of turnover or income;
  • missed bookings;
  • reputational damage;
  • loss of data;
  • costs due to disruptions or delays;
  • damage caused by incorrect settings;
  • damage caused by external platforms or connections;
  • damage caused by incorrect or incomplete information from users;
  • claims from guests or third parties.

To the extent that Homadu should nevertheless be liable, liability is limited as set out in Homadu’s Terms and Conditions.

No professional advice
All information provided by Homadu via the website, software, help articles, emails, documentation or communication is intended as general support for using the software.

This information does not constitute legal, tax, financial, administrative, technical security or other professional advice. The user remains responsible for decisions made on the basis of this information.

Applicable law
This disclaimer and the use of Homadu are governed by Dutch law, unless mandatory law provides otherwise.
Disputes will be handled as set out in Homadu’s Terms and Conditions.
